Trump Administration Resumes $5B EV Charger Funding After Court Ruling Ends Illegal Freeze

The Trump administration has at last issued new guidance permitting states to assign $5 billion toward the development of electric vehicle charging infrastructure, following months of delays in releasing the funds.

A coalition of states initiated a lawsuit concerning the funding freeze within the National Electric Vehicle Infrastructure (NEVI) program, which was part of the administration’s endeavor to halt appropriated funds from Congress at the start of Donald Trump’s second term. In June, a judge recognized the states’ case as compelling and granted an injunction against the hold on funding.

The Department of Transportation (DOT), headed by former MTV personality Sean Duffy, criticized the states for their sluggish progress in utilizing the available funds. By May, around 84% of the $5 billion (authorized under the Bipartisan Infrastructure Law) had not been allocated, with only a few charging stations built.

Duffy and the DOT maintained that the funding was paused merely for a “review process” to guarantee alignment with the administration’s goals for the NEVI program. A new press release issued on Monday details the aspects of that process.

As anticipated, the revised guidance seeks to enhance the review process for charging stations. States will no longer be obligated to consider consumer protections, emergency evacuation plans, environmental factors, and various other previously required processes before commencing construction. Furthermore, the DOT has discarded the requirement for a specified percentage of charging stations to be situated in rural, underserved, or disadvantaged communities.

Additionally, the DOT has updated the guidance to eliminate the mandate that funding proposals “show how the implementation will support solid labor, safety training, and installation standards.” Moreover, the revisions have removed the necessity for applicants to create opportunities for participation from minority- and women-owned small businesses.
