Inquiry into Fitness for Office: Report on Adv Chauke Presented to President Ramaphosa

Johannesburg – The investigation into the appropriateness of suspended Gauteng Director of Public Prosecutions Advocate Andrew Chauke has been finalized, and the results have been presented to President Cyril Ramaphosa.

Vincent Magwenya, the spokesperson for the President, revealed that the report was submitted earlier today, Wednesday, 1 July 2026, by Retired Constitutional Court Justice Baaitse Elizabeth Nkabinde.

Advocate Chauke has been on suspension for approximately a year due to serious allegations of misconduct, which include claims of serving as a gatekeeper and using the National Prosecuting Authority (NPA) to protect politically connected individuals.

On 29 September 2025, President Ramaphosa launched the Inquiry pursuant to section 12(6)(a) of the National Prosecuting Authority Act 32 of 1998.

The Inquiry aimed to determine whether Advocate Chauke was fit and suitable to continue in his position, given the grave allegations regarding his behavior.

The Terms of Reference were constructed in accordance with the National Prosecuting Authority Act and section 179 (3) of the Constitution.

President Ramaphosa placed Advocate Chauke on suspension effective from 20 July 2025, pending the inquiry’s results.

“Today, President Ramaphosa expressed his appreciation to Inquiry Chairperson Justice Nkabinde, along with Adv Elizabeth Baloyi-Mere SC and Attorney Matshego Ramagaga, for the panel’s dedicated work,” said Magwenya, the President’s spokesperson.

“President Ramaphosa will now review the report and make a decision subsequently.”
